如果您决定使用我们产品提供的服务，本协议用于告知我们对于用户的隐私如何收集、使用和披露。

一、许可提示

MUXWAVE（以下称“该系列软件”）是由深圳市美矽微视觉技术有限公司（以下称“本公司”）拥有所有权与经营权的产品。 用户在使用软件之前，请您仔细阅读本协议内容。您成功进入软件使用界面，即表示您已认真阅读并完全理解本协议的全部内容，与本公司已达成协议，自愿接受本服务条款的所有内容及不定时更新的内容。

二、使用规则

为了维护互联网秩序、保障用户在使用该软件过程中的合法权益，请您理解并同意以下条款：用户下载该系列软件应当通过正当路径，其中：电脑版控制软件应当通过本公司官方网站下载，或者通过本公司发货时提供给用户的光盘进行安装。 手机APP 软件的下载，其中Android版软件下载应通过小米、华为、VIVO、OPPO等各手机品牌自营应用商店， 以及腾讯应用宝、Google Play等第三方应用商店处下载；iOS版软件下载应通过苹果公司App Store处下载。 用户应当按照法律规定使用该系列软件，并按照本公司提供的用户手册、操作说明、说明书等说明文件进行操作。用户按照上述文件进行操作出现问题时，请您立即联系工作人员，以便及时处理问题。 用户在使用该系列软件Wi-Fi通信、U盘通信、网络通信时，应当修改Wi-Fi密码，其中密码强度应当符合要求。 该系列软件重大安全更新实行强制升级制，即用户只有在更新升级软件后才能继续使用。用户在对该系列软件升级的过程中，应当按照本公司提供步骤说明进行。 本公司通过多种方式（包括但不限于通知、公告、提示、短信等）作出的任何声明、通知等内容均视为本协议的一部分。用户使用该系列软件的同时即视为同意该声明、通知等。 用户使用该系列软件时，应当遵守法律法规，不得利用该系列软件发布以下内容：

  1. 反对宪法所确定的基本原则的；
  2. 危害国家安全，泄露国家秘密，颠覆国家政权，破坏国家统一的；
  3. 损害国家荣誉和利益的；
  4. 煽动民族仇恨、民族歧视，破坏民族团结的；
  5. 破坏国家宗教政策，宣扬邪教和封建迷信的；
  6. 散布谣言，扰乱社会秩序，破坏社会稳定的；
  7. 散布淫秽、色情、赌博、暴力、凶杀、恐怖或者教唆犯罪的；
  8. 侮辱或者诽谤他人，侵害他人合法权益的；
  9. 含有法律、行政法规禁止的其他内容的信息。

如果用户知道任何人违反上述规定，请直接联系用户下载的具体软件客服。

三、隐私条款

本公司秉持尊重和保护用户个人隐私的原则。本公司将采取技术措施和其他必要手段，确保收集的用户个人信息安全，不会篡改、毁损收集到的用户个人信息；不会在未经合法用户授权时对外披露用户注册资料及用户保存在该系列软件中的非公开内容，但下列情况除外：

  1. 事先获得用户的明确授权；
  2. 根据有关法律法规的规定或相关政府主管部门的要求；
  3. 为维护社会公共利益的需要。

四、法律责任

  1. 用户通过其他非正规途径下载该系列软件导致用户本身系统出现故障的，本公司不承担任何责任；若构成对本公司知识产权侵害的，应当依法承担法律责任。
  2. 用户提供虚假、无效的注册信息并采用技术手段通过本公司的形式审查，或违法使用该系列软件，给第三人造成损害或者被行政机关予以行政处罚的，本公司不承担任何责任；用户上述行为构成刑事犯罪的，依法应当承担相应的刑事责任。如因用户的虚假行为，导致本公司受到行政处罚的，本公司有权追责。
  3. 用户未按照本公司提供的用户手册、操作说明、说明书等说明文件进行操作导致的任何后果，本公司不承担任何责任。
  4. 用户在对该系列软件升级的过程中，因其本身操作错误造成的任何后果，本公司不承担任何责任。

五、适用法律

本服务条款的订立、执行和解释及争议的解决均应适用中国法律并受中国法院管辖。 如本服务条款与中华人民共和国法律相抵触时，则该等条款将按法律规定重新修订，而其他条款则依旧有效并具有法律效力。 如双方就本服务条款内容或其执行发生任何争议，双方应尽量友好协商解决；协商不成时，任何一方均可向本公司所在地的人民法院提起诉讼。

If you decide to use the services provided by our products, this Agreement is used to inform us of how we collect, use and disclose users’ privacy.

1、Permission to prompt

MUXWAVE(hereinafter referred to as “the Software Series”) is made by Shenzhen MUXWAVE Technology Co., Ltd. (hereinafter referred to as “the Company”) products in which the company has ownership and management rights. Please read this agreement carefully before using the software. If you successfully enter the software interface, it means that you have carefully read and fully understand all the contents of this Agreement, and have reached an agreement with the Company to voluntarily accept all the contents of the Terms of Service and the contents to be updated from time to time.

2、Use rules

In order to maintain the order of the Internet and protect the legitimate rights and interests of users during the use of the software, please understand and agree to the following terms:Users should download the series of software through the proper path, where:The computer version control software shall be downloaded from the company’s official website or installed on the CD-ROM provided by the company to the user when delivered. Download mobile APP software, Android version of which should be downloaded through the self-run APP stores of xiaomi, Huawei, VIVO, OPPO and other mobile phone brands. And Tencent App Treasure, Google Play and other third-party app stores;The iOS version should be downloaded through the Apple App Store to download. To use the software, users must complete the registration process and bind their mobile phone number. The mobile phone number must be authenticated by the real name of the domestic communication carrier. Users shall guarantee the authenticity, validity and legality of the registration information.The password shall be set and kept as required during or after registration. Users shall use the series of software in accordance with laws and regulations, and operate in accordance with the user manual, operation instructions, instructions and other explanatory documents provided by the company. If any problem occurs when a user performs operations based on the preceding files, contact the personnel immediately to rectify the problem. When using the software for Wi-Fi communication, USB flash drive communication, or network communication, users should change their Wi-Fi passwords. The password strength should meet requirements. The major security updates of this series of software implement the mandatory upgrade system, that is, users can continue to use the software only after updating and upgrading the software. When upgrading the software, users should follow the instructions provided by the company. Any statement, notice or other content made by the Company through various means (including but not limited to notice, announcement, prompt, SMS, etc.) shall be deemed as a part of this Agreement.By using the software, the user agrees to the statement, notice, etc. Users shall abide by laws and regulations when using this series of software and shall not use this series of software to publish the following contents:

  1. Those that oppose the basic principles laid down in the Constitution;
  2. Endangering state security, divulging State secrets, subverting state power or undermining national unity;
  3. Harming the honor and interests of the State;
  4. Inciting ethnic hatred or discrimination or undermining ethnic unity;
  5. Sabotaging the state’s religious policies and propagating heresies and feudal superstitions;
  6. Spreading rumors, disturbing social order and undermining social stability;
  7. Spreading obscenity, pornography, gambling, violence, murder, terror or abetting a crime;
  8. Insulting or slandering others or infringing upon the lawful rights and interests of others;
  9. Information containing other contents prohibited by laws and administrative regulations.

If the user knows anyone who violates the above regulations, please contact the customer service of the specific software downloaded by the user directly.

3、Privacy policy

The company adheres to the principle of respecting and protecting users’ privacy. The Company will take technical measures and other necessary means to ensure the security of the collected personal information and will not tamper with or damage the collected personal information. It will not disclose user registration information and non-public contents saved by users in this series of software without authorization of legitimate users, except for the following circumstances:

  1. Obtain the explicit authorization of the user in advance;
  2. In accordance with the provisions of relevant laws and regulations or the requirements of relevant government departments;
  3. In order to maintain the needs of social public interests.

4、The legal responsibility

  1. If users download the software through other informal means, the Company will not assume any responsibility for the failure of the user’s own system. In case of infringement of intellectual property rights of the Company, the company shall bear legal liabilities according to law.
  2. If a user provides false or invalid registration information and uses technical means to pass the examination of the Company, or uses the software in violation of the law and causes damage to a third party or is subject to administrative punishment by administrative authorities, the Company shall not be liable.If the aforesaid acts constitute criminal crimes, users shall bear corresponding criminal liabilities according to law.If the company is subject to administrative penalty due to the user’s false behavior, the Company has the right to hold the company responsible.
  3. The company shall not be liable for any consequences caused by the user’s failure to operate in accordance with the user manual, operation instructions, instructions and other explanatory documents provided by the company.
  4. In the process of upgrading this series of software, the company will not be responsible for any consequences caused by its own operation errors.

5、The application of law

The establishment, execution, interpretation and dispute settlement of the Terms of Service shall be governed by the laws of The People’s Republic of China and under the jurisdiction of the people’s Court of China. If these Terms of Service conflict with the laws of the People’s Republic of China, such terms will be revised in accordance with the provisions of the law, while other terms remain valid and have legal effect. In case of any dispute arising from the content or execution of the Terms of Service, both parties shall try to resolve it through friendly negotiation.If no agreement can be reached through negotiation, either party may file a lawsuit with the people’s court in the place where the company is located.
